Job Description:

 

  • Experience in Banking / NBFCs Retail Asset Products, specifically in Commercial vehicle and Construction equipment lending division with Legal and collection experience
  • Expertise in handling cases of all nature like Civil, Criminal, Commercial, Arbitration, Vigilance, Conciliation & etc.,
  • Knowledge of Collection Processes.
  • Well versed with Injunctions, Specific Relief Laws, Money suits, Mortgage Suits, arbitration, Executions & Negotiable Instruments act, legal notices (Loan recall notice/ demand notices/ legal notice to default customers), Lok Adalat, and conciliation monitoring & rigorously follow up.
  • Efficient in handling & initiating legal actions against fraud cases / defaulters/ insolvent clients.
  • Efficient in drafting & vetting of letters & documents.
  • Supporting collections team by timely and accurate initiation of relevant proceedings under Arbitration and Conciliation Act, NI Act, SARFAESI Act and Insolvency & Bankruptcy Code.
  • Defending Company is consumer court, motor vehicles act and Labour matters.
  • Resourceful with the ability to assess all legal issues and producing professional results while adhering to rigid guidelines with regard to countries laws and company’s policy.
  • Proficient in preparing Legal Notices of all kinds, Plaints, Written statements, Writ Petitions, Appeals, Case Papers, Affidavits for legal proceedings.
  • Liasoning & attending Government Departments, Courts & Police Station to ensure compliance and in crisis management.
  • Effective networking skills and Vendor management (Advocates & Associate management), Empanelment and coordination with external counsel PAN India
  • Interpersonal & communication skills, ready to work in cross functional teams.
  • Ability to deal and interact with different levels of people and to effectively manage the advocates.
  • Effective leadership skills & training & development of legal matters to the collection team members.
  • Efficient around legal process and identify areas of work on process improvement on ongoing basis.
  • Efficient in systems & procedure and to maintain MIS, files, and Co-ordination for Arbitration orders for delinquent customers
  • Follow the legal recovery strategy and maximizing the recovery, implement the approach and set a recovery objective for the actives.
  • Maintaining and updating the legal MIS on a regular basis, new legal tools and procedures are being implemented and initiate a project to reduce the legal costs.
  • To account for the majority of non-performing assets (NPAs) and build bespoke solutions to maximize returns on investment
  • Ensure prioritization and quick resolution of non-starter & Early default cases by quick notices
  • To conduct periodical review of efforts and progress for all 90+ cases, skip and fraudulent cases
  • Develop a robust operational risk/controls framework for Legal collections
  • Providing detailed report in the month end about the activity planned/executed and variance with reasons and next month planning to Head of Collections
  • Perform administrative duties (calendar hearings and deadlines, organise case files, manage logistics etc) 
  • Maintain pleadings and discovery indexes
  • Organize exhibits, documents, evidence, briefs and appendices Aid attorneys with interrogatories and other discovery requests Gather relevant information from a variety of sources
  • Support collections team members in repossession process including various interim letters/notices issuing and release of good notices and Presale and Post sale notices issued in timely.

 

Education, Experience & Key Skills

 

  • Law degree
  • Minimum 10 years’ experience in collection legal in Banking / NBFCs Retail Asset Products, specifically in Commercial and Construction equipment lending division.
  • Sound knowledge of collection /Legal expertise
  • Knowledge of SARFAESI act/SEC 9 / Arbitration/Conciliation
  • Team player, good negotiation skills
  • Must possess exceptional communication skills that are especially important in enabling effective communication between consumers and external partners.
  • Drafting reports, delivering presentations to consumers, senior management, stakeholders, and external partners
  • An energetic go-getter, motivator, and creative individual with high work ethics
  • Should be self-motivated, have a strong entrepreneurial spirit, be adaptable to business growth fluctuations, work comfortably and effortlessly in group settings, be a persuasive individual, thrive in a fast-paced environment, and work well under the pressure of stringent deadlines
  • Proficiency in the use of MS Office applications
  • Willingness to travel, High level of field connect.
  • Knowledge of working in a process driven organisation
  • Should be able to converse fluently in English, Hindi & Regional Languages will be added advantage.
