What you will do

This is a rare opportunity to shape the compliance strategy of two iconic brands - Mack Trucks and Volvo Trucks North America - while advising senior leadership on critical legal matters.

 

Mack Trucks & Volvo Trucks North America (VTNA) are looking for a Senior Compliance Counsel to join our Legal & Compliance team on-site in Greensboro, North Carolina. Mack Trucks and VTNA’s core compliance areas include:

1.    Data privacy and AI 
2.    Antitrust
3.    Export controls and sanctions
4.    Anticorruption
5.    Whistleblowing and investigations

 

The ideal candidate will have significant experience with either data privacy and AI (CIPP preferred), or antitrust matters, and will have a willingness to develop expertise in our other core compliance areas. 
The successful candidate will play a pivotal role in shaping the governance structures and the organizational direction of the compliance function. Far from routine, this position involves international collaboration with a compliance leadership team responsible for developing a global compliance strategy, and will interact directly with senior executives, while driving our business objectives in a compliant manner.

 

The position reports to General Counsel of Mack Trucks and Volvo Group North America.

Key Responsibilities Include:

1.    Compliance Leadership Team

•    Serve on the Volvo Group’s global Compliance Leadership Team (CLT).
•    Represent Mack Trucks’ and VTNA’s interests and act as North America’s first point of contact for the CLT.
•    Help develop compliance policies, training, communication strategy, and global compliance priorities.
•    Oversee rollout of global compliance policies and adapt to local needs.
•    Participate in best-practice sharing with global colleagues. 
•    Contribute to Group level reporting.

 

2.    Compliance Management

•    Lead the Mack Trucks and VTNA’s executive level Compliance Committee.
•    Provide legal advice, policy guidance, and training to executives and employees on compliance-related matters.
•    Further develop, implement, and oversee Mack Truck’s and VTNA’s Compliance Management System (CMS) to ensure adherence to relevant laws, regulations, and internal policies.
•    Develop and propose compliance governance structures within Mack Trucks and VTNA to ensure effective implementation and risk management.
•    Propose and request mandates and, where appropriate, budget from Mack Truck’s and VTNA’s Compliance Committee for necessary implementation of compliance improvement activities.
•    Support and develop communications and activities to facilitate compliance leadership and tone from the top.
•    Report on compliance activities and KPIs.
•    Conduct regular audits, assessments, and effectiveness testing to identify compliance risks and areas for improvement.
•    Collaborate cross-functionally with other Volvo Group compliance officers and Volvo Group business areas to share best practices, address compliance issues impacting multiple legal entities and brands, and implement corrective actions where necessary.
•    Liaise with regulatory agencies and external legal counsel as necessary to address compliance inquiries.
•    Manage or support investigations per Volvo’s Whistleblowing & Investigations policy.

 

3.    Regulatory Compliance

•    Stay abreast of changes in laws, regulations, and industry standards relevant to our business operations.
•    Interpret regulatory requirements and assess their impact on company policies and procedures.

 

4.    Legal Counsel Activities

•    Review, draft, and negotiate a wide range of commercial agreements, including but not limited to NDAs, sales agreements, terms and conditions of sale, dealer agreements, telematic service agreements, and customer contracts.
•    Draft dealer policies and bulletins.
•    Provide legal advice and support to the business areas relating to competition law, anti-corruption, privacy, and export control.
•    Handles other tasks as assigned.

Success Looks Like:

1.    Build trusted advisory relationships with senior executives and lower-level employees.
2.    Complete a risk-based assessment of the current compliance program within 90 days.
3.    Develop an auditable plan to address high risks identified during the assessment.
4.    Lead a new cross-functional compliance initiative across Mack and VTNA.

Required and Preferred Qualifications
1.    You hold a Juris Doctorate from an Accredited Law School and a license to practice law in at least one state. 
2.    You have at least 7 years prior legal & compliance experience as a compliance officer or in-house counsel. 
3.    You have subject matter expertise in one or more of the following areas (and a willingness to develop experience or familiarity with all): data privacy, competition law, anti-corruption law, and/or export control law. 
4.    Experience in the transportation industry or with automotive or heavy truck products work is a plus.
